Increasingly, we are seeing courts advising, and in some jurisdictions requiring, that parties first seek Alternative Dispute Resolution before going to court.
We encourage parties to find their own mutually agreed resolution to their issues with the help of the mediator. Parties may take their legal opinions from their own Counsel, if Counsel is present. Anything expressed by the mediator at any time in the mediation session is not a legal opinion, but simply a view based on experience. A mediation is settled by the parties on their own terms or on advice of their own Counsel.
